Terms and Conditions

These Terms & Conditions ("Agreement") govern your use of the Simple Hang platform ("Platform"), owned and operated by KGC Katlish General Contractors Ltd., operating as Simple Hang ("Company"). By accessing or using the Platform, you agree to these terms.

1. ACCEPTANCE OF TERMS

1.1 By accessing or using the Platform, you acknowledge that you have read, understood, and agree to comply with these Terms & Conditions. 1.2 If you do not agree with any part of this Agreement, you must not use the Platform. 1.3 The Company reserves the right to modify these terms at any time. Continued use of the Platform constitutes acceptance of the updated terms.

2. SERVICES PROVIDED

2.1 The Platform provides a space where users ("Users") can connect with independent contractors ("Listeners") for emotional support through audio and video sessions. 2.2 Listeners are not licensed therapists, counselors, or medical professionals and do not provide therapy, medical advice, or clinical treatment. 2.3 The Platform is not a substitute for professional medical, psychiatric, or emergency services.

3. USER ELIGIBILITY

3.1 You must be 18 years or older to use the Platform. 3.2 You affirm that all information you provide is accurate and that you have the legal capacity to enter into this Agreement.

4. USER RESPONSIBILITIES

4.1 You agree to use the Platform responsibly and ethically. 4.2 You shall not engage in any behavior that is offensive, discriminatory, harassing, or illegal while using the Platform. 4.3 You shall not attempt to solicit, share personal contact information, or engage in off-platform transactions with Listeners. 4.4 You acknowledge that all interactions with Listeners are at your own discretion and risk.

5. PAYMENTS & REFUNDS

5.1 All payments are processed through the Platform, and the Company retains a service fee from each transaction. 5.2 Payments are non-refundable, except in cases of technical failure or other extraordinary circumstances at the Company's sole discretion. 5.3 The Company reserves the right to change pricing and fees at any time.

6. LIMITATION OF LIABILITY

6.1 No Warranty: The Company makes no guarantees regarding the effectiveness or quality of services provided by Listeners. 6.2 User Assumes Risk: You acknowledge that the Company is not responsible for any emotional, psychological, or other outcomes resulting from your interactions on the Platform. 6.3 Indemnification: You agree to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from your use of the Platform. 6.4 No Liability for Listeners' Actions: The Company is not liable for the actions, conduct, or statements made by Listeners during sessions.

7. CANCELLATION & TERMINATION

7.1 The Company reserves the right to terminate or suspend your access to the Platform at any time, with or without cause, and without notice. 7.2 Users may cancel their accounts at any time, but no refunds will be issued.

8. CONFIDENTIALITY & PRIVACY

8.1 The Company respects user privacy and complies with applicable privacy laws, including British Columbia’s Personal Information Protection Act (PIPA). 8.2 The Platform does not record or store user conversations with Listeners. 8.3 Users must not share confidential or sensitive personal information during sessions.

9. DISPUTE RESOLUTION

9.1 Informal Resolution: Users must attempt to resolve disputes by contacting Simple Hang support before taking legal action. 9.2 Binding Arbitration: If a dispute cannot be resolved informally, it shall be settled through binding arbitration in British Columbia, Canada. 9.3 No Class Actions: Users waive their right to participate in class-action lawsuits against the Company.

10. GOVERNING LAW

10.1 This Agreement shall be governed by and interpreted in accordance with the laws of British Columbia, Canada. 10.2 Any legal proceedings arising from this Agreement shall be subject to the jurisdiction of British Columbia, Canada.

AGREEMENT VALIDITY

This Agreement must be signed by the Listener on or before March 13, 2025. If not signed by this date, the offer shall be considered null and void unless extended in writing by the Company.

ACKNOWLEDGMENT & AGREEMENT

By using the Simple Hang platform, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
